Crystal Falls man sent to jail for identity theft

CRYSTAL FALLS – A Crystal Falls man accused of identity theft was sentenced to jail time in Iron County Trial Court on Monday.

Darwyn Aberly, 47, pleaded guilty to one felony count of identity theft, which carries a maximum penalty of five years in prison.

One felony count of identity theft and two felony counts of unauthorized credit application were dismissed on a prosecutor’s motion.

Aberly was sentenced to serve four months in jail, followed by one year and six months probation.

In a statement to the court, the victim said Aberly used his identity to obtain a business credit card, and maintained credit in his name for approximately seven years.

During this time, the victim said, he and Aberly were close friends and played together in the local rock and country band Next Myle.

According to the band’s website, Aberly was a member from 2003 until 2013.

Restitution in the case remains open as the court waits to receive information from the credit card company involved.
